The Implications of Speciality Seniority - Read Carefully

Serious promotion anomalies in new G.O-- panel senioroty in specialty would prevail over CML seniority. Rural service is ignored

கிராமப்புறத்தில் பணிபுரியும் மருத்துவர்களை பாதிக்கும் விதியை உடனடியாக ரத்து செய்ய வேண்டும்

இதுவரை அமலில் இருந்த விதிமுறை : ஒரு மருத்துவர் முதலில் அரசு பணியில் சேரும் போது கிராமப்புற ஆரம்ப சுகாதார நிலையத்தில் சேர்ந்தாலும், அல்லது அரசு மருத்துவமனையில் மருத்துவக்கல்லூரியில் சேர்ந்தாலும், ஒரே பணி மூப்பு - CML (Civil Medical List) based on TNPSC Seniorty - என்ற விதி இது வரை நடைமுறையில் உள்ளது.

அதாவது அவர்கள் கிராமப்புற மருத்துவமனைகளில் பணிபுரியும் காலகட்டம் அவர்களது பதவி உயர்விற்கு (TNPSC Seniorty) எடுத்துக்கொள்ளப்பட்டது

தற்சமயம் அரசாணை 354 நாள் 23.10.2009ன் படி இந்த விதி மாற்றப்பட்டுள்ளது (பார்க்க படங்கள் 25 - 26 Illustration 4)
எனவே மருத்துவர்கள் ஆரம்ப சுகாதார நிலையங்களில் பணிபுரியும் காலகட்டமும், அவர்கள் பணியில் சேரும் போது உள்ள CML சீனியாரிட்டிக்கும் மதிப்பிலை என்று ஆகிறது now the time spend by a medical officer in PHC is totally wasted

அவர்கள் மருத்துவக்கல்லூரியில் உதவிப்பேராசிரியராக பணியில் சேரும் நாள் மட்டுமே அவர் பேராசிரியராவதற்கு தகுதி என்றாகிறது

கிராமங்களில் 3 முதல் 4 வருடம் பணிபுரிந்து அதன் பிறகு பட்ட மேற்படிப்பு படிக்கும் மருத்துவரை விட கிராமப்புறங்களில் ஒரு நாள் கூட பணிபுரியாதவர் சீனியாரகும் அவல நிலையை இந்த ஆணை உருவாக்குகிறது

இந்த விதி உடனடியாக ரத்து செய்யப்பட வேண்டும்.

உதாரணமாக 2006 வரை கிராமப்புறங்களில் சேர்ந்தவர்கள் (ஒப்பந்த அடிப்படையில் சேர்ந்தவர்கள் உட்பட) இது வரை யாரும் படித்து முடிக்க வில்லை. இவர்கள் அனைவரும் படித்து முடித்து மருத்துவக்கல்லூரிகளில் சேர்வது 2013க்கு பிறகு தான்ஆனால் 2007 முதல் 2013 வரை படிக்கும் non service pg மருத்துவர்கள் இவர்களை விட சீனியாரும் வகையில் இந்த ஆணையில் விதி உள்ளது. இது கிராமப்புறங்களில் பணிபுரியும் மருத்துவர்களை பாதிக்கிறது.

இந்த புதிய விதியினால் இனி வரும் காலங்களில் கிராமப்புறங்களில் பணிபுரிய மருத்துவர்கள் விரும்பாமல் நேரடியாக மருத்துவக்கல்லூரியில் சேரவே விரும்புவார்கள்.

பல வருடங்களுக்கு முன்னர் இருந்தது போன்ற நிலை ஏற்பட வாய்ப்பு உள்ளது

எனவே இந்த புதிய விதியை உடனடியாக ரத்து செய்து, தகுதி இருப்பின், அனைத்து பதவி உயர்வுகளும், CML மூப்பு அடிப்படையிலேயே வழங்கப்பட்ட வேண்டும் என்றும் அனைத்து seniority panelகளும் CML சீனியாரிட்டியின் அடிப்படையிலேயே இருக்க வேண்டும் என்றும் மாற்றப்பட வேண்டும்

IF A PERSON JOIN THE DEPARTMENT HE STICKS TO THAT POST NOT ALLOWING THE NEXT ONE GET TEACHING EXPERIENCE. BY MAKING TEACHING EXPERIENCE A GUIDELINE FOR PAYBAND 4, WE ARE MAKING THE UNLUCKY ONES PERMANENTLY UNLUCKY. SO TEACHING EXPERIENCE CANNOT BE A YARDSTICK FOR PAYBAND-4.

· PAY DISCREPANCY AMONG DOCTORS WORKING IN DIFFERENT DEPARTMENT CURRENTLY EXISTS; WHERE A JUNIOR DOCTOR IN A PARTICULAR DEPARTMENT CAN TAKE HOME WITH A HEAVY PURSE THAN A SENIOR DOCTOR IN ONE ANOTHER DEPARTMENT. THIS ANOMALY WILL BE PRESENT

ORDER :
The following Notification will be published in the Tamil Nadu Government
Gazettee .
NOTIFICATION.
WHEREAS, the rights of practitioners of Indian System of Medicine are
protected under section 17(3) (b) of the Indian Medicine Central Council Act, 1970
(Central Act 48 of 1970) ;
AND WHEREAS, as per section 2 (1) (e) of the said Act, “Indian Medicine“
means the system of Indian Medicine commonly known as Ashtang Ayurveda, Siddha
or Unani Tibb whether supplemented or not by such modern advances, as the Central
Council of Indian Medicine may declare by notification from time to time ;
AND WHEREAS , the Central Council of Indian Medicine in its Notification
F.No.28-5/2004-AY.(MM), dated the 19th May 2004, has clarified that the word “Modern
Advances” in clause (e) of section 2 (1) of the said Act as advances made in the
various branches of modern scientific medicine in all its branches of internal
medicine , surgery, gynaecology and obstetrics , anesthesiology, diagnostic procedures
and other technological innovation made from time to time and declare that the courses
and curriculum conducted and recognized by the Central Council of Indian Medicine are
supplemented with such modern advances ;
AND WHEREAS , the Central Council of Indian Medicine has improved and
strengthened the syllabus of Indian Medicine by including subjects with regard to
National Programmes like National Malaria Eradication programmes, Tuberculosis,
Leprosy, Family Welfare Programme, Reproductive and Child Health Programme,
Immunisation Programme, AIDS, Cancer etc ;

Now, THEREFORE, under sub - clause (iii) of clause (ee) of rule 2 of the Drugs
and Cosmetics Rules, 1945 the Governor of Tamil Nadu hereby declares every
registered medical practitioner holding the qualifications specified in the second, third
or fourth Schedule to the Indian Medicine Central Council Act, 1970 (Central Act
48 of 1970) and Part III of the Schedule to the Tamil Nadu Siddha System of Medicine
(Development and Registration of Practitioners) Act , 1997 (Tamil Nadu Act 34 of 1997)
and registered in the Medical Register of the State maintained under the aforesaid
Acts, as a person practicing the modern scientific system of medicine for the purposes
of the Drugs and Cosmetics Act, 1940 (Central Act 23 of 1940.)

Fees for Medical examination and issue of physical fitness certificated payable to the Assistant Surgeons and Civil Surgeons

Order:
In the G.O. First read above, orders were issued amount other enhancing the fees for Medical
examination and issue of physical fitness certificated payable to the Assistant Surgeons and Civil Surgeons or
indicated below:

2. The Tamil Nadu Assistant Surgeons association has requested for revision of fee as indicated below:-

After careful examination, Government have decided to enhance the existing rate of fees
3. Accordingly the Government direct that the fees for Medical examination and issue of physical fitness
certificate etc., payable to the Assistant Surgeons and Civil Surgeons be enhanced as indicated in column 3
below :

    YELLOW COLOUR ARE VARIABLE DATA.
all doctors kindly go thru the data entered in the cml list and if you find any entries wrong pertaining to your name please send the appeal format thru JD/DDHS/ESI RAMO/DEAN at the earliest.
all district office bearers kindly coordinate with estblishment staff  and officals to speed up this process ''. apart from verifiying your data if you find any doctors name in the list who is not in service kindly please ask your dist officials to send a mail to dms office from when they are  missing in service, what action has been initiated and if they have any particulars about them let that be communicated to dms office.

PREFACE 
      The Civil Medical List consists of the details of Doctors working in Tamil Nadu Medical Service comprising DM&RHS/DME/DPH&PH & ESI.  The Director of Medical and Rural Health Services is the unit officer as a whole for the Civil Medical List.  The CML No. is assigned to the Doctors based on the rank obtained by them in the TNPSC selection.  The data given in the TNPSC selection list are adopted in the CML without any change. This list is being updated in a biennial manner.   
      The last CML was published as on 1.1. 2005.  Due to administrative reasons the publication of new CML has been postponed many times. Now a new CML has been prepared and ready for publication by 01/06/2010.   
      It has been decided to publish the new CML list in three parts i.e. PART-I, PART-II AND PART-III for administrative reasons as detailed below: 

PART-I
Contains the list of Doctors arranged in seriatim according to the rank obtained in TNPSC Selection.

PART-II
Contains the list of Doctors who have Retired/VRS/Resigned/Expired


PART-III
Contains the details of Doctors selected by TNPSC against various specialists for the year 2003-2004.  CML No. has not been assigned, since overall ranking was not assigned by TNPSC in the          2003-2004 Selection(only specialist wise seniority assigned by TNPSC).  The issue is under correspondence between DPH&PM and TNPSC and CML No. for those candidates will be assigned later after getting remarks from the TNPSC.


      The tentative CML for the year 2009 was released on 01/10/2009. Instructions were issued then that any omission / corrections should be brought to the knowledge of the unit officer for rectification.  Accordingly many appeals have been received and those defects pointed out in the appeal format alone have been  rectified. All the corrections so far brought to the knowledge of Unit Officer have been incorporated 
      In order to finalise the Publication of new CML by 1.6.2010 another final opportunity is given to all concerned to rectify any error / omission of data if any found in above list by way of submission of an appeal format on or before 31/05/2010.

      It has been proposed to fill up the existing posts of Chief Civil Surgeon (General/Specialists) from the category of Senior Assistant Surgeons working in General side.  A list containing the names of Medical Officers who are at present working in the cadre of Senior Assistant Surgeons in DMS / DPH / ESI are furnished in Annexure I & II for verification and furnishing Service Particulars in the format enclosed. The service particulars obtained  from the Medical Officer incharge / below the rank of DDHS/JDHS will not be accepted.  The names of those Medical Officers who have not been promoted as Senior Assistant Surgeon due to pendancy of  Disciplinary action / undergoing punishment and for want of Service Particulars are furnished in Annexure II & IV .
      2) As per the orders contained in the G.O.Ms.No.354/H&FW/B2/Dept, dt:23/10/2009 the counseling for SAS to CCS post will be conducted only for the SAS working in the DM&RHS /DPH&PM / ESI Wing for the  remaining  post  of Chief Civil Surgeon (General/Specialist).  The Doctors working in the DME side even though  promoted as Senior Assistant Surgeon are not considered in this re-fitment exercise since DME have become a separate unit as per the G.O. cited. 
      3) All the Unit Officers are requested to adhere to the instructions mentioned below without fail:
    1. As per the new reorganized system the  promotions /re-fitment are to be given to the posts of Chief Civil Surgeon(General/Specialists). The Medical Officers with MBBS Degree qualifications will qualify for CCS(G) promotions and others with PG Degree/Diploma  qualifications will be moved to the Specialists posts depending upon the vacancies. Therefore verification of qualification of each and every Medical Officers enlisted above plays a vital part in determining their promotions/re-fitment. Hence utmost  caution should be exercised in furnishing the qualification-based reports. Any false information / mis-matched particulars are furnished promotion of an individual  will be affected and for this lapse  each and every Officers right from Assistant/Office Superintendent/Administrative Officer/JDHS will be held responsible and stern disciplinary action will be initiated against them for negligence / dereliction of duty.

    1. All the required details should be compulsorily furnished in the prescribed format duly indicating the CML NO 2005/ Qualification / Present Station  without fail.  For each and every Medical Officer the former/present present station is must even if they are not working in their Districts.  Avoid vague remarks like particulars not available / present station not known / service register not available etc.   
    2. Another important aspect in this re-fitment exercise is that  verification of present station and designation  of all the above Medical Officers and if there is any change it should be properly reported in the format enclosed .

    1. The Medical Officers holding double Degree qualification should
      exercise one time option for promotion / re-fitment  in any one of the Specialities  according to their choice and their future promotions will be determined based on this option only and it cannot be altered at any time.
    1. All the Medical Officers enlisted above are already promoted as
      Senior Assistant Surgeon as per this office records  and if any of them are still in the rank of Assistant Surgeon their designation may be changed by obtaining a copy of panel / promotion order from this Directorate by deputing the concerned Assistant to this office.    
    4) The Tamil Nadu Govt. Doctors Association is frequently giving abnormal pressure to this office to publish the re-fitment list of CCS and other posts immediately and very often submitting memorandums to this office highlighting this point. In view of emergent situation all the Unit Officers are requested to send the particulars called for immediately on or before Schedule date as notified in the Annexure V. No further extension of time will be granted and this correspondence is one and the last for this third phase of re-fitment exercise.  It is specifically informed that  the re-fitment will be done based on the particulars available in the Directorate and thereafter if any omission is noticed in future the concerned officers will be held responsible for this lapse and further action will be taken as deem fit as per the rules 
    5) This list of SAS can be accessed through E_mail ID’s of all District Officers and can be browsed in www.tnhealth.org & www.tn.gov.in. The Official letter and the list will be communicated shortly.  Hence all the officers are requested to treat the list hosted in the website as an official document for all purpose. 
    6) Kindly circulate all the Annexure (I to IV) to all the Govt. Hospitals / PHCs /ESI Dispensaries and other foreign service institutions coming under their zone  and also to  paste the list in the prominent place /notice board of the Hospitals  concerned.
    7) It is informed that the DM&RHS has proposed to convene a meeting in his chambers on 21/05/2010 at 11.00 A.M. regarding  this re-fitment exercise.  At that time he will deliver a lecture  on the ongoing re-fitment exercise done in this Directorate.  Hence all the Assistants / Office Superintendents  dealing with Doctors establishment in the Unit Office are instructed to attend the meeting without fail.   All the Assistant / Office Superintendents can directly interact with the HOD and to get clarified their common doubts arising out of this re-fitment process initiated in the Unit Office.  They should come  prepared    with notes on this issue so that their queries may be answered.  No one should be absent for the meeting.  Similarly the Assistant  / Office Superintendent dealing with doctors subject from DDHS office / ESI wing should also attend this meeting without fail.  
    8) A copy of the list will be handed over to them on 21/05/2010 and as per the schedule noted in the Annexure V all the District head should submit the formats without fail.
